RETURNS AND FAILED OR SHORT DELIVERY

Orders may only be cancelled and/or Goods may only be returned at the Seller’s sole discretion.  If such request is accepted by the Seller, the price for those Goods (if already paid) shall be credited by the Seller and, where appropriate, we will credit your credit or debit card for the price of the cancelled order.

The Seller is not liable to the Buyer for:

Shortages in quantity delivered unless the Buyer notifies the Seller of a claim within three days of receipt of the Goods; and

Damage to or loss of the Goods or any part of them in transit (where the Goods are carried by the Seller’s own transport or by a carrier on behalf of the Seller) unless the Buyer notifies the Seller of a claim within three days of receipt of the Goods or their anticipated delivery date.

Terms and Conditions

All sales are subject to Unigraph UK Limited (hereafter referred to as Unigraph) Terms and Conditions of sale.

Sale Contract

a) When you place an order for any material or product by submitting a completed order form on the website, your contract with us will commence when Unigraph confirms acceptance of your order by automatic email ("Contract''). We agree that we will supply the items listed on the said order.

b) These Terms and Conditions shall govern the Contract to the exclusion of any other Terms and Conditions. Failure by Unigraph to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these Terms and Conditions.

c) Any advice or recommendations given by any representative of Unigraph to you relating to items of equipment, which are not confirmed in writing by Unigraph, will not be binding on Unigraph.

d) Variations to these Terms and Conditions may from time to time be made available on the website.

1. Ordering

In submitting an order you acknowledge that:

a) All information and specifications relating to the items of equipment represented on the website are approximate and Unigraph is not responsible for the accuracy of content provided.

b) Unigraph may make any changes to the specification of items of equipment to conform to any statutory or European requirements.

2. Product Description

We attempt to be as accurate as possible. However, Unigraph does not warrant that descriptions of equipment or other content of this website are accurate, complete, reliable, current or error-free. Your sole remedy, should equipment be other than described on the website, is to return the equipment in an unused state.

3. Pricing Policy

a) The price of the resources shall be the price as quoted on the website on the date the order was placed, subject to any inadvertent pricing errors (whether technical or otherwise) by Unigraph.

b) The price of the items may be subject to a post and packing rate as shown on the order form page of the site.

c) The price does not include the cost of delivery to destinations outside the United Kingdom. For such orders, we will be pleased to quote a shipping charge on request.

d) All prices are subject to the applicable Value Added Tax, which you shall be liable to pay to Unigraph.

4. Credit Cards

a) Credit and debit cards accepted by Unigraph are listed on the website.

b) All payments by credit or debit cards will be taken prior to despatch of goods. Any fraudulent use of credit or debit cards will be notified to the authorities along with any identification details that were supplied with the order.

c) Any refund made to your credit or debit card shall be subject to the terms and conditions of the relevant issuing bank and therefore be subject to any time delay as specified by the issuing bank. We are not liable for any delay that is outside our control. A correct cardholder name and address must be supplied at the time of ordering where it is different from your name and address.

5. Delivery

a) We aim to deliver within 2 working days on receipt of order. Next day service is usually possible if requested.

b) If you do not take delivery of the goods, or give Unigraph adequate delivery instructions, we shall not be liable for any loss or damage or deterioration to the goods delivered.

c) If you do not receive all the goods as specified on your original order, you must notify Unigraph in writing within 14 working days from the date of delivery. If you do not inform Unigraph in writing within the specified time, then no liability will be attached to Unigraph. In any event, any loss or damage you suffer as a result of such a delivery shall be limited to the price of the goods not delivered or the cost of replacement goods.

d) Risk of loss and title of the goods pass to you on delivery by us to the relevant carrier.

6. Right of Cancellation

You have the right to withdraw from the contract within 7 working days of acceptance by us of your order for the items, by giving us written notice of withdrawal. Unigraph shall, where appropriate, credit your credit or debit card for the price of the cancelled order. Any credit will include any charges we made against small orders and any post and packing charge levied.

7. Warranty

Subject to clause 13 below, Unigraph warrants that the goods will correspond to the order at the time of delivery and will be free from defects on delivery. If Unigraph is in breach of this warranty, you shall notify Unigraph within 14 working days from the date the defect is discovered. On receiving a notice of failure of warranty, Unigraph may, at its sole option, either replace all the faulty items or refund the price of the items that are defective.

8. Withdrawal of Resources

Unigraph may withdraw the sale or distribution to you of any products without prior notice, or liability.

9. Copyright

All material included on this site is the property of Unigraph or its content providers and is protected by UK and international copyright laws.

10. Access to the Website

Unigraph grants you the right to use this website for your personal use but not to download or modify it or any part of it except with our prior written consent. This licence does not include any resale or commercial use or derivative use of the website or its contents. No part of the site may be used for commercial purposes without the express written consent of Unigraph.

11. Disclaimer and Liability

a) This website is provided by Unigraph on an "as is" basis. We make no representations or warranties of any kind, express or implied, as to the operation of this site or the information content, materials or products included on this site. You agree that your use of this site is at your sole risk.

b) To the full extent permissible by applicable law, Unigraph disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose.

c) Unigraph does not warrant that this website, its servers or e-mail sent from Unigraph are free from viruses or other harmful components.

d) Unigraph will not be liable for any damages of any kind arising from the use of this website, including, but not limited to, damages for consequential loss.

e) These exclusions of liability will not apply to any damages arising from death or personal injury caused by the negligence of Unigraph or any of its employees or agents.

12. Applicable Law

The Contract and these Terms and Conditions shall be subject to English law and the parties submit to the non-exclusive jurisdiction of the English Courts.
